The Presidency in Court: Judicial Review of Executive Orders, 2001 - 2025

This solo paper analyzes trends and determinants of judicial challenges to executive orders from the start of the GW Bush Administration to the end of the Biden Administration. Preliminary results suggest that the court’s willingness to overturn the president fundamentally changed in 2017, and these effects carried through the Biden Administration. This paper was presented at SPSA 2026.
